Wills and Lasting Powers of Attorney

Wills

We will meet with you to discuss your requirements before writing to you with a draft Will for your approval. We will then meet with you again to sign the top copy of your agreed Will or, if it is more convenient for you, send it to you with instructions regarding signing.

We will store your original Will free of charge and send you a copy for your records. Of course if you would prefer to look after the original yourself, we will make it available for collection from our offices.

We are also able to offer home visit to take your instructions, when coming in to one of our offices would be difficult.

Legal Fees

Our fees are based on our hourly rate of £225 plus VAT.

For a simple Will for an individual, without advice regarding Inheritance Tax or trusts, our fees are between £150 and £250 plus VAT.

For mirror Wills for a couple, without advice regarding Inheritance Tax or trusts, our fees are between £225 and £300 plus VAT.

If you are considering leaving a partner a life interest in your share of any jointly owned home, in order to protect against care fees for example, and require a life interest Will, our mirror Wills for a couple are typically between £500 to £600 plus VAT.

If you require a more complex Will then our fees will be charged at our hourly rate of £225 plus VAT and an estimate will be provided before we prepare the draft.

Lasting Powers of Attorney

There are two types of Lasting Power of Attorney (LPA) – for property and financial affairs and for health and care decisions.

By appointing a(n) Attorney(s) under these powers, they can assist you in dealing with banks and other organisations, as well as speak up for you in the future if you were not able to do so yourself.

In order to be used, the LPAs need to be registered with the Office of the Public Guardian and we would recommend that this be done when the powers are created so they are ready to use if, or when, necessary. It currently takes up to a couple of months for the registration process to be completed, so having them registered and ready for use can be reassuring.

Disbursements

When registering the LPAs, the Office of the Public Guardian charge a registration fee of £82 per power. It may be that your financial circumstances mean that you are exempt or you qualify for a reduction in this fee and we will be able to discuss this with you when we meet to take your instructions.
